Introduction

These Terms of Service govern your use of the SummitGPX website, platform and related services.

SummitGPX is a product of Bimotech Solutions Ltd, a company registered in England and Wales. By accessing or using SummitGPX, you agree to be bound by these terms.

Use of the Service

SummitGPX provides tools for hosting, managing, sharing and embedding GPX routes, communicating route updates and managing related event information. You agree to use the service lawfully and in accordance with these terms.

User Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately if you believe your account has been compromised.

Subscription Plans

Certain features of SummitGPX require a paid subscription. Subscription fees are billed in advance and may be changed by us with reasonable notice.

Payments

Payments are processed by third party payment providers such as Stripe. By subscribing to a paid plan, you authorise recurring charges where applicable until your subscription is cancelled.

Cancellation and Refunds

You may cancel your subscription at any time. Unless otherwise stated, your subscription will remain active until the end of the current billing period. Fees already paid are non refundable except where required by law.

User Content

You retain ownership of GPX files, route data, images, logos and other content you upload to SummitGPX.

By uploading content, you grant us a limited permission to store, process, copy, transmit and display that content only as necessary to provide, maintain and improve the service.

Event and Route Responsibility

SummitGPX provides tools for publishing, sharing and communicating route and event information. Event organisers and users remain solely responsible for the accuracy, legality, safety and suitability of any routes, GPX files, maps, instructions, communications and event information published through the platform.

SummitGPX does not independently verify uploaded routes or event information and does not guarantee that route information is complete, accurate or suitable for navigation.

SummitGPX does not guarantee that a participant or recipient will receive, open, read or act upon any notification or communication sent through the platform.

Recipient Information and Communications

Where you upload names, email addresses or other recipient information, you confirm that you have the necessary permission and lawful basis to collect, upload and use that information.

You are responsible for ensuring that communications sent using SummitGPX comply with applicable privacy, data protection, electronic communication and anti spam laws.

Prohibited Use

You must not:

• Use the platform for unlawful, fraudulent or abusive activities.
• Attempt to gain unauthorised access to systems, accounts or data.
• Upload malicious software, viruses or harmful content.
• Interfere with the operation, availability or security of the platform.
• Infringe the intellectual property rights of another person or organisation.
• Send spam or unsolicited communications.
• Use recipient information without the appropriate permission or lawful basis.
• Reverse engineer, decompile, copy or attempt to reproduce the platform or its underlying technology, except where permitted by law.
• Use automated systems to scrape, extract or collect data from the platform without our written permission.

Availability

We aim to provide a reliable service but do not guarantee uninterrupted or error free availability. Maintenance, upgrades, service provider failures or unforeseen issues may occasionally affect access to the platform.

We may modify, suspend or withdraw parts of the service where reasonably necessary for maintenance, security, legal or operational reasons.

Data and Backups

We take reasonable steps to protect data stored within SummitGPX. However, you remain responsible for maintaining your own copies of important GPX files, route information, recipient data and other content. We cannot guarantee that data will never be lost, corrupted or unavailable.

Intellectual Property

All intellectual property rights in SummitGPX, including its software, source code, design, branding, databases, documentation, features and underlying technology, remain the property of Bimotech Solutions Ltd unless otherwise stated.

These terms give you a limited, non exclusive, non transferable and revocable right to use SummitGPX for its intended purpose. They do not transfer any ownership rights in the platform to you.

Third Party Services

SummitGPX may rely on or integrate with third party services, including hosting, mapping, analytics, email delivery and payment providers. We are not responsible for failures, interruptions, changes or actions caused by third party services outside our reasonable control.

No Warranties

SummitGPX is provided on an "as is" and "as available" basis. We do not guarantee that the service will meet every requirement, be suitable for every purpose, operate without interruption or be completely free from errors or security vulnerabilities.

Limitation of Liability

To the maximum extent permitted by law, Bimotech Solutions Ltd shall not be liable for indirect, incidental, special or consequential loss arising from the use of, or inability to use, SummitGPX.

This includes loss of profits, revenue, business, goodwill, anticipated savings, data or event participation resulting from inaccurate route information, missed communications, service interruptions or user error.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Suspension and Termination

We may suspend or terminate an account where these terms have been breached, payment is overdue, use of the account creates a security or legal risk, or continued access could harm the platform, other users or our business.

Where reasonably practical, we will provide notice before suspending or terminating an account, unless immediate action is necessary to protect the platform, users or third parties.

Events Outside Our Control

We are not responsible for delays, interruptions or failures caused by events outside our reasonable control, including internet or telecommunications failures, power outages, cyber attacks, natural disasters, government action or failures affecting third party service providers.

Changes to These Terms

We may update these Terms of Service from time to time. Where changes are significant, we will take reasonable steps to notify users. Continued use of SummitGPX after updated terms take effect constitutes acceptance of the revised terms.

Governing Law

These terms are governed by the laws of England and Wales. Any dispute arising from or relating to these terms or the use of SummitGPX shall be subject to the exclusive jurisdiction of the courts of England and Wales.
